Terms of sale
1. Scope and acceptance
These General Terms of Sale (hereinafter, "the Terms") govern the purchase of products through the website https://praceira.com (hereinafter, "the Shop"), owned by Praceira S.L. (placeholder). They apply to consumers and users within the meaning of Spanish Royal Legislative Decree 1/2007 of 16 November approving the consolidated text of the General Law for the Protection of Consumers and Users (TRLGDCU) and, insofar as compatible with their status, to business buyers. Sales to businesses and the hospitality trade may additionally be governed by specific conditions agreed in writing.
By placing an order you declare that you are over 18 and accept these Terms, the Legal notice and the Privacy policy in full. We recommend reading them and keeping a copy. You can consult and print them at any time from this page.

3. Products
We sell fresh seasonal chestnuts and other natural products (dried chestnuts, walnuts, honey, chestnut flour) and tools. The essential characteristics of each product are described on its page. Please note that:
- Chestnuts and walnuts are natural, seasonal products: the calibre stated on each page is an indicative range (number of pieces per kilo) and appearance, colour and size may vary between batches and over the season.
- The stated weight is the net weight at the time of packing. Fresh chestnuts naturally lose moisture, so the weight on receipt may be slightly lower.
- In a product with no post-harvest treatment it is normal to find a small percentage of damaged pieces (worm-eaten, mouldy or empty) despite our grading and curing. See section 10 if the percentage is significant.
- Allergens: walnuts are tree nuts. Our products are handled in facilities where tree nuts are also handled. Allergen information appears on each product page and on the labelling.
- Photographs and illustrations are indicative and do not form part of the contract.
4. Prices
Prices are in euros and include the applicable VAT. They do not include shipping costs, which are calculated and shown before you confirm the order according to destination and amount, as set out on the Shipping & returns page.
The applicable prices are those published in the Shop at the time the order is placed. We reserve the right to change them at any time without affecting orders already confirmed. In the event of an obvious typographical or computer error in a price, we will let you know and you may confirm the order at the correct price or cancel it at no cost.
Prices in the trade and wholesale section are shown excluding VAT and are subject to the conditions agreed with each business customer.
5. Ordering process and confirmation
No registration is needed to buy. The process consists of the following steps:
- Add products to the basket and choose size and quantity.
- Review the basket, enter the delivery address and choose the payment method. Before confirming you will see a summary with the products, the total price including taxes and the shipping costs.
- By pressing the payment button you place an order with an obligation to pay (art. 98.2 TRLGDCU).
- Once payment has been processed you will receive a confirmation email with the order number, product details, amount and these Terms. That email constitutes the acknowledgement of receipt provided for in Article 28 of the LSSI-CE.
The contract is concluded when the confirmation is sent. If a product is unavailable after payment, we will inform you immediately and refund the corresponding amount within a maximum of 14 days. We reserve the right not to accept orders where there is a well-founded suspicion of fraud, non-payment or abuse of promotions.
The contract is concluded in Spanish; we offer English and Portuguese versions for information purposes and, in the event of discrepancy, the Spanish version shall prevail. We archive the electronic contract document; you can request a copy at hola@praceira.example.
6. Payment
You can pay by credit or debit card, also through Apple Pay or Google Pay, via our secure payment gateway (Stripe). Payment details are entered directly into the gateway, which is PCI DSS compliant; Praceira does not access or store your full card number.
For card payments, the charge is made when the order is confirmed, including for pre-orders. To prevent fraud we may verify the details provided and, where appropriate, cancel the order with a full refund.
Pay on delivery. Where the Shop offers it for your order (depending on the delivery area, the amount and the products, as shown before you order), you can pay the courier in cash on delivery. The cost of this service, if any, is shown as a separate line before you confirm the order and is never more than the carrier charges us for it. The amount to pay on delivery cannot reach 1,000 €, the legal limit for cash payments to a business. By placing the order you undertake to pay for it on delivery. We may ask you to confirm it with the link we send you by email: if you do not confirm it within 24 hours, it is cancelled automatically and you owe nothing.
If you refuse or do not collect a pay-on-delivery order. Refusing the parcel is not the way to withdraw from the contract: you can withdraw as explained in clause 9, also after receiving it. If the parcel comes back unpaid, the order is cancelled and no invoice is issued. We may stop offering you pay on delivery for later orders; card payment remains available.
7. Pre-orders and estimated dates
Before the season starts we offer the option to pre-order fresh chestnuts and other seasonal products. Each product page and the order summary show the estimated date on which shipping starts (for the 2026 season, from 28 September for fresh chestnuts).
That date depends on how the harvest ripens and on the weather, so it may be brought forward or delayed by a few days; we will notify you of any change by email. If the delay from the estimated date exceeds 15 days, or if the harvest does not allow us to fulfil your pre-order, you may keep it or cancel it and receive a full refund within a maximum of 14 days.
Pre-order discounts apply only to orders placed during the stated period and cannot be combined with other promotions unless otherwise indicated.
8. Shipping and delivery
We ship to mainland Spain, the Balearic Islands and mainland Portugal. For now we do not ship to the Canary Islands, Ceuta or Melilla, or to other countries; we will add destinations over time and publish them on the Shipping & returns page.
Indicative delivery times from dispatch: 1-3 working days in mainland Spain, 2-4 in the Balearic Islands and 2-4 in Portugal. Fresh chestnuts are only shipped Monday to Thursday so they never spend a weekend in a warehouse. Unless a different period is stated, we will deliver within a maximum of 30 days from confirmation (art. 66 bis TRLGDCU); for pre-orders the period runs from the estimated shipping start date.
Shipping costs, and the amount from which they are free, are shown before you confirm the order. Delivery is made to the address provided; if no one is there, the courier will make a second attempt or leave the parcel at a pick-up point. If the order is returned because of an incorrect address or because it was not collected, we may charge you the cost of re-shipping; for perishable products re-shipping may not be possible.
The risk of loss or damage to the products passes to the consumer when they, or a third party designated by them other than the carrier, take physical possession of the goods (art. 66 ter TRLGDCU).
9. Right of withdrawal
If you buy as a consumer you have the right to withdraw from the contract within 14 calendar days from the day you, or a person you designate, receive the product, without giving any reason. To exercise it, simply inform us unequivocally before the period expires, by email to hola@praceira.example or by post to Rúa da Praza, 1, 32001 Ourense (Galicia), España. You may use the form below, although it is not compulsory.
Exception for perishable goods. Under Article 103(d) TRLGDCU, the right of withdrawal does not apply to goods liable to deteriorate or expire rapidly. This is the case for fresh chestnuts and the packs that contain them. This exclusion does not affect your rights if the product arrives in poor condition (see section 10).
Nor does it apply to sealed goods which are not suitable for return for health protection or hygiene reasons and which have been unsealed after delivery (art. 103(e)), for example an opened jar of honey or bag of flour.
For all other products (tools and unopened pantry products) you must return the product without undue delay and in any case within 14 days of telling us your decision, in its original packaging and in perfect condition. The direct cost of returning the goods is borne by you. You are liable for any diminished value of the product resulting from handling other than what is necessary to establish its nature, characteristics and functioning.
We will refund all payments received, including standard delivery costs (but not the additional costs if you chose a more expensive delivery option), without undue delay and within a maximum of 14 days from the day we learn of your decision, using the same means of payment. We may withhold the refund until we have received the goods or proof of their return.
10. Guarantee and goods in poor condition
All our products are covered by the legal guarantee of conformity of the TRLGDCU (Articles 114 et seq.). For non-perishable products the guarantee period is 3 years from delivery; for fresh and pantry products, conformity is assessed according to their nature and best-before date.
If your order arrives damaged, in poor condition or does not match what you ordered, write to us within 24 hours of delivery at hola@praceira.example or by WhatsApp, quoting the order number and attaching photographs of the parcel and the product. This window is especially important for fresh produce so we can assess the issue; reporting it later does not void your rights but may make verification harder.
Once the issue has been assessed we will offer you, at your choice, a replacement in the next available shipment or a refund of the affected amount (in full or in proportion to the damaged part). For fresh chestnuts we consider up to 5% defective pieces normal; above that percentage we will replace or refund the affected part. You will not need to return the product unless we expressly ask you to, in which case we will bear the cost.
This guarantee does not cover damage resulting from inadequate storage after delivery (for example fresh chestnuts kept in a sealed bag or in a warm place). Storage recommendations are given on each product page and in the FAQ.
11. Customer service and complaints
For any enquiry, incident or complaint you can contact us at hola@praceira.example, by telephone on +34 600 000 000 (Monday to Friday during office hours) or through the contact form. We will respond to complaints as quickly as possible and in any case within one month.
We keep official complaint forms (hojas de reclamaciones) available to consumers in accordance with Galician consumer protection regulations; you can request them through any of the channels above.
12. Dispute resolution
In the event of a dispute we will try to resolve it amicably through our customer service. In addition, as a consumer you may turn to:
- The Spanish Consumer Arbitration System, through the relevant Consumer Arbitration Board, and municipal and regional consumer information offices (in Galicia, the Instituto Galego do Consumo e da Competencia, consumo.xunta.gal).
- Consumer alternative dispute resolution bodies accredited under Spanish Law 7/2017 of 2 November. Praceira S.L. (placeholder) informs you that, unless expressly stated otherwise, it is not a member of any alternative dispute resolution body, without prejudice to considering participation on a case-by-case basis.
The European Online Dispute Resolution (ODR) platform ceased operating on 20 July 2025 under Regulation (EU) 2024/3228, so it is no longer possible to submit complaints through it.
13. Applicable law and jurisdiction
These Terms are governed by Spanish law. If you buy as a consumer resident in another Member State of the European Union, you are also protected by the mandatory consumer protection rules of your country of residence.
The courts of the consumer's place of residence shall have jurisdiction over any dispute arising from the purchase. For sales to businesses, the parties submit to the courts of Ourense.
14. Other provisions
If any clause of these Terms is declared void or unenforceable, the remainder shall remain valid. Failure by Praceira S.L. (placeholder) to exercise a right does not constitute a waiver of it. We may update these Terms; each order is subject to the version in force at the time it is placed, which is attached to the confirmation email.
